Problem 2 - Proper Recording

Even though the root of a major problem was outlined 

in the previous posting, AND we are now aware that there 

is a difference between "SUCCESSIVE" and "CONSECUTIVE",

AND even if the two words are interchangeable (which 

they are not), AND if there actually was a RESOLUTION 

(which there is not), to make a new by-law binding, all new 

BY-LAW RESOLUTIONS must be recorded. 


        Since 2018, the SC Homeowners Association 

        Act states the following: "In order to be enforceable, 

        all governing documents for a homeowners association 

        must be recorded in the public registry of the county 

        where the property is located. 


        To continue to be enforceable, governing documents not 

        recorded prior to May 17, 2018 must be recorded by January 

        10, 2019. 


    “Governing documents” includes declarations, master deeds 

    or bylaws or any amendments to the declaration, master 

    deeds or BYLAWS.


OUR BY-LAWS ARE PROPER, CURRENT, AND BINDING.


Now, per the FERRIS desire to "run things" at Egret Run, AM 

FERRIS must be "in the know" that the so-called RESOLUTION, 

giving her permission to stay on the board perpetually, must 

be recorded (which it is not, because it does not exist).  

The rules and regulations were properly recorded in 2019, 

in compliance, so the ER BOD, NOBLE, and AM FERRIS have been 

deceiving all of us for a long time. 


Based upon these facts and specifically our by-laws, four (4) of the

(5) current members of the Egret Run Board are illegitimate,

and now that they are aware (even if they were not before), 

should resign, for the sake of fairness, honesty, and most 

of all, good governance.           


In Egret Run HOA  History 2, we learned how AM Ferris has 

used a resolution that has not to this day existed, to  

justify her scheme which has allowed her to run for the 

ER HOA board, perpetually.  Several of us have asked 

questions for years as to why that is fair, only to be 

ignored. While we might appreciate her willingness to 

serve on the ER BOD, if you have been an owner in ER, and 

especially if you actually live here, chances are pretty 

good that you have encountered or experienced AM FERRIS 

in a bad way.   


It is not fair and in a later post,I will try to explain

a recent incident that led me to go to extraordinary 

lengths that I have gone to, to convince every homeowner 

in Egret Run about the importance of making every effort 

to ensure good governance. We have seen it in another HOA

of which we are a member.  


We cannot succumb to the personal whims of AM FERRIS 

or anyone else when it comes to good governance if we 

want to maximize the value of our real property.
